"Complementarity is the cornerstone of the system created by the Rome Statute. Complementarity gives States the primary responsibility for prosecuting international crimes. The ICC will only intervene when states are unwilling or unable genuinely to investigate or prosecute. For complementarity to function it is imperative that States introduce legislation prohibiting genocide, crimes against humanity and war crimes".
